Terms and Conditions

These Terms and Conditions ("Terms") govern use of the Secure Check Pro™ platform ("Platform") operated by Secure Brand Management Inc. ("SBM"). By accessing or using the Platform, you agree to these Terms.

1. Purpose of the Platform

The Secure Check Pro platform is a clearance authorization management system used exclusively in connection with the San Diego Community College District (SDCCD) Measure HH Bond Program. The Platform facilitates the collection of FCRA-compliant authorization forms and the management of site access clearance records.

2. Authorized Users

Access to the Platform is restricted to:

SBM Administrators: Authorized SBM staff managing the clearance program
Employers: Companies contracted under the SDCCD Measure HH Bond Program who have been granted portal access by SBM
Candidates: Individual workers accessing the Platform via a unique secure link to complete their authorization forms

3. Candidate Acknowledgments

By completing and submitting authorization forms through the Platform, you acknowledge and agree that:

You have read and understood the FCRA Disclosure provided to you
You authorize Secure Brand Management Inc. to obtain a consumer report for the purpose of site access clearance determination
Your electronic signature has the same legal validity as a handwritten signature under the Electronic Signatures in Global and National Commerce Act (ESIGN) and the Uniform Electronic Transactions Act (UETA)
The information you provide is accurate and complete to the best of your knowledge

4. SMS Communications

By providing your mobile phone number through your employer, you consent to receive a one-time SMS message from Secure Check Pro containing a secure link to complete your authorization forms. Message and data rates may apply. Reply STOP to opt out. Reply HELP for assistance.

5. Data Accuracy

You are responsible for providing accurate personal information. SBM is not liable for clearance decisions resulting from inaccurate information provided by the candidate.

6. Limitation of Liability

SBM's liability in connection with use of the Platform is limited to the maximum extent permitted by applicable law. SBM is not responsible for decisions made by employers or SDCCD regarding site access based on clearance check results.

7. FCRA Compliance

All clearance check activities conducted through the Platform are governed by the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., and the California Investigative Consumer Reporting Agencies Act (ICRAA), California Civil Code § 1786 et seq. SBM complies with all applicable requirements including pre-adverse action and adverse action notice procedures.

8. Modifications

SBM reserves the right to modify these Terms at any time. Continued use of the Platform constitutes acceptance of updated Terms.

9. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law provisions.
